What Does a Private Certifier Do in Byron Shire?

A private certifier in Byron Shire is an accredited building professional who can assess your plans and issue Construction Certificates, Complying Development Certificates and Occupation Certificates in place of Byron Shire Council. Under the Environmental Planning and Assessment Act 1979 the property owner chooses who acts as Principal Certifier — council or a private certifier. A builder cannot make that appointment for you.

Byron Shire Is Not a Straightforward Planning Environment

Byron Shire carries a denser set of planning constraints than any other council area we work in. A single site can sit under several at once, and each one changes what you can build and what your certifier has to verify before a certificate can be issued.

The ones that come up most often on Byron jobs:

  • Coastal hazard — much of the coastal strip from Belongil through to South Golden Beach falls within coastal management areas mapped under the State Environmental Planning Policy (Resilience and Hazards) 2021.
  • Flood — low-lying land around Mullumbimby, Brunswick Heads and the Belongil catchment carries flood planning levels that drive floor heights and material selection.
  • Bushfire — hinterland and coastal-heath sites frequently require a Bushfire Attack Level assessment and construction to AS 3959. Our Broken Head studio project is a worked example of a bushfire-prone Byron Shire site taken from Construction Certificate through to Occupation Certificate.
  • Biodiversity and koala habitat — vegetation and habitat mapping across the shire can restrict building envelopes and site works.
  • Heritage — Bangalow and parts of Mullumbimby and Brunswick Heads contain heritage items and conservation areas.
  • Acid sulfate soils — common on low-lying coastal land, and relevant to excavation and footing design.

The practical consequence is that Byron Shire projects are less likely than most to qualify for the Complying Development pathway, and more likely to need a Development Application first. One point worth being clear about: a private certifier does not replace the Development Application. Where your Byron Shire project needs a DA, that assessment stays with council. Which Certificates Can We Issue in Byron Shire?

Construction Certificates (CCs) — required once Byron Shire Council has approved your Development Application. The CC confirms your plans comply with the National Construction Code and relevant Australian Standards before work starts on site.

Complying Development Certificates (CDCs) — a single approval combining the planning and construction steps, available for straightforward residential projects that meet the applicable planning controls. Alongside certification we also provide dilapidation reports — frequently a condition of consent for excavation, demolition or work near a neighbouring boundary, and common on Byron Bay’s tighter infill sites — and pool barrier inspections under the Swimming Pools Act 1992, required before a property with a pool can be sold or leased.

How Does the Certification Process Work?

Occupation Certificate

After the final inspection passes, we issue the Occupation Certificate so the building can be occupied or used.

You can use either. The choice is yours as the property owner — under the Environmental Planning and Assessment Act 1979 a builder cannot appoint the certifier for you.
